Arran Holiday Rentals Terms and Conditions

Bookings

The receipt of a signed online/paper booking form and full payment is deemed to be a firm booking. Bookings are not confirmed until payment is made in full.

Cancellations

If cancelled prior to 60 days from entry, 50% of the booking value will be refunded and Arran Holiday Rentals will retain the other 50% of the booking value.

If the hirer cancels a confirmed booking within 60 days of entry, they remain liable for payment of the full cost of the holiday and no booking refund will be given.

Refunds are given at the discretion of the management.

Arrivals/Departures

Rentals commence, unless otherwise notified, at 4pm on the day of arrival and terminate at 10am on the day of departure to allow the changeover to commence.

General

The number of persons occupying a property must not exceed the maximum occupancy level stated in the property details. Owners reserve the right to terminate the occupancy of the property without notice or refund in the case of a breach of this condition.

Arran Holiday Rentals is a booking agent for the owner and when the hirer books a property the booking contract is between the owner and the hirer. Arran Holiday Rentals has no liability for the implementation of the booking contract or for the acts or omissions of the owner or other person or party represented or employed by the owner. Arran Holiday rentals has no liability for the condition of the property and/or the contents of the property which are the sole responsibility of the owner.

Arran Holiday Rentals or the Owners have the right to decline handing over the property to the hirer if there are justifiable grounds to believe that the hirer or any of the persons included in the booking contract are not suitable to occupy the property. A full refund will be given. The hirer will not be entitled to any compensation or damages for cancellation of the booking for this reason.

Arran Holiday Rentals or the owner cannot be held responsible for loss or damage to any belongings or for injury sustained by the hirer or members of his or her party during their stay at the accommodation.

Arran Holiday Rentals or the owner shall be allowed the right of entry to the property at all reasonable times for the purposes of inspection or to carry out any necessary repairs or maintenance.

The use of any amenities, where offered, such as swimming pools, bicycles, boats, barbeques etc is entirely at the user's risk and no responsibility can be accepted by the Property Owner for any death or personal injury (save to the extent that such death or personal injury was caused by the negligence of the Property Owner). No liability for any other loss or damage in connection with the use of such amenities is accepted.

Housekeeping

The hirer is responsible for the condition of the property and its entire contents during the hire period, fair wear and tear excepted. The hirer will make good any damage or loss and leave the property and contents in a clean and tidy condition. The person held responsible for the hiring party will be the person who made the booking. Arran Holiday Rentals or the owner reserves the right to make a charge for extra cleaning if the property is not left in a satisfactory condition.

In some cases, owners ask for a Good Housekeeping Deposit prior to the commencement of each holiday. This is returnable to the hirer upon written request or will otherwise be destroyed by Arran Holiday Rentals no sooner than one week following the rental period. Should return of the cheque be requested, amounts to be returned will be less the cost of making good any damage or loss to the property or for any excessive cleaning found necessary following the period of occupation. It is a condition of the let that the hirer leaves the property and its contents clean and tidy.

It is important to the property owner and Arran Holiday Rentals that you enjoy your holiday and every effort has been made to ensure this. However, in the unlikely event of dissatisfaction with the property or any subsequent problem, the hirer must immediately contact Arran Holiday Rentals or the owner so that the opportunity to rectify the problem is given.

Termination

AHR and, or the owner or his/her managers reserve the right to terminate this agreement and request the immediate departure of all persons from the property in the event of a serious breach of the terms of this agreement. The breach may include but is not limited to the following events:

a) serious damage to the property.

b) a criminal or illegal act.

c) unreasonable or abusive behaviour or

d) excessive noise which could adversely affect the rights of AHR or the owner being able to continue to operate the property for short lettings or involve authorities or police in any form of complaint investigation.

Contractual

Arran Holiday Rentals act only as an agent for the owners of the properties featured on this web site. The contract is between the hirer and the owner.

The contract effected between the hirer and the owner of the property is in terms of Schedule 4 Section 8 of the housing act (Scotland) Act 1988 and confers on the hirer the right to occupy the property for the period agreed for holiday purposes only.

Specific conditions and restrictions applying to certain properties (e.g damage security deposits, restrictions on pets, young children etc) will be mentioned in individual property descriptions, and will be deemed to form part of these Terms and Conditions.

Data Protection

The Hirer's details may be passed solely to the owners of the properties for accounting purposes only. Your personal information will not be sold or otherwise passed on to any other third parties.

Other

Travel Insurance is recommended.
